New lawsuit against Robert Rodriguez could prevent release of “Machete Kills’

Robert Rodriguez – the famed director behind cult hits like Sin City – knows what audiences want, making the oh-so-hot sequel to 2010’s Machete one of the most eagerly-anticipated films of 2013. Even so, there’s a possibility that his film “Machete Kills” – which began production earlier this year – may never be released, depending on how a complaint filed by Overnight Production proceeds in court.

Overnight Productions filed a lawsuit last Tuesday against Robert Rodriguez’s production company, Quick Draw Productions, and Machete Kills LLC, Deadline reports. Overnight Productions – the production company behind “Machete” – is asking for $2 million in damages and is requesting permission to terminate an April 2012 agreement which gave Rodriguez the rights to produce a follow-up to the film about the character of Machete, who is hired by the U.S. to track down an arms dealer in Mexico.

The complaint alleges that Rodriguez withheld tax information and budget figures about “Machete Kills,” (required “so that it can determine the producer fee owed with respect to the sequel” reads the complaint) and if Overnight is successful in their suit, rights to the film would revert to Overnight Productions operating producer Rick Schwartz — and it would possibly be pulled from release.

Overnight Productions did not return NBC Latino’s request for comment.

“Although defendants have produced the sequel, they have failed to meet a condition precedent to their grant of rights, forcing plaintiffs to terminate the agreement,” states the complaint. “Defendants have also failed and refused to provide the required budget information to Overnight Productions so that it can determine the producer fee owed with respect to the sequel. As a result, plaintiffs have been forced to bring this action to confirm the cancellation of the grant of rights and to recover the amounts plaintiffs are owed.”

Citing Rodriguez’s busy schedule – the 44-year-old is currently shooting “Sin City 2” – his reps declined to provide comment to NBC Latino.

“Machete Kills” is set to hit theaters in July 2013 and starring alongside title star Danny Trejo is a star-studded cast including Jessica Alba, Michelle Rodriguez, Sofia Vergara, Mel Gibson and Charlie Sheen. The action film will also star pop star Lady Gaga in her very first feature film as sexy seductress La Chameléon.
